    Public vs. Private Beach - New Legal Article

    We just received the June 2009 Florida Bar Journal, and the lead article is entitled:

    Sand for the People
    The Continuing Controversy Over Public Access to Florida's Beaches

    The first paragraph starts as follows:
    Lola Carlisle, an Atlanta resident visiting Seagrove, on the Florida Panhandle’s Emerald Coast in July 2007, thought her summer vacation was going to end up as a trip to jail after her children were building sandcastles on property a nearby homeowner claimed was private. She and her family had been vacationing in Seagrove for a decade but had never before been told to move off of “private” beach, and she questioned whether the white sand upon which her family had laid its towels was really private.....
    The article is essentially a treatise on the various legal theories used in Florida and other states to both preserve and limit the public’s right to use the beach. It’s an interesting article and just goes to show how complicated this issue has become.

    the beaches were created by God for the enjoyment of all....excepting, of course, the ones (from near and far) who leave trash, cigarette butts, broken glass, leftovers from a beach-side renezvous, and/or unwanted items (because they're too lazy to drag them back to high ground/a dumpster), and those who detract from the enjoyment of all by being rowdy (drunk to the point of harassing others, especially kids/family), unsociable/inhospitable, rude, or crude. I'm an advocate for the rights of those who pay big bucks for ocean-front property, but one must be reasonable.....
