Customary use does not obviate the private beach. The beach is still private but it can be used by the public. I do not believe that beach vendors are allowed on the beaches owned by private entities.

It looks like the BCC has been doing this since 2002 but the current Comptroller for the County has expressed concern that this type of expenditure is not specifically authorized by the 2002 ordinance.

In previous years Walton BCC acknowledged that there is private beach property not subject to Customary Use when the WCSO established procedures for removing trespassers on private beach property.
