Sugar Cliffs Beach Access

Does anyone know anything about a suit supposedly filed against Walton County by the Sugar Cliffs Owner's Association wanting to close the public beach access across from Cassine Village in Seagrove Beach? I believe that Walton County has maintained the access, even rebuilt the walkway after Hurricane Ivan at county expense, but it's my understanding that the suit, which was filed in 2002, is scheduled to be heard sometime this month (mid August?) Say it's not so!!
