This parcel is not commercial, and should not become commercial. It's current use is nonconforming, and that's OK ... most everyone's glad it's back operating as it was.
But CHANGING it to full-on commercial zoning is a bad idea, whether it would've been for the completely ill-conceived NatureWalk beach club, or for a larger hotel/restaurant, or for etc etc.
There's not enough area for parking or traffic movement there, and any more-intensive uses there would be completely incompatible with the surrounding properties.
Please help stop this horseshirt.

Email all of the commissioners NOW, and plan to be at this meeting.
Remind them that this parcel is designated Residential Preservation, which in their own document means that it is in an established, platted, built out neighborhood (which it is). It is in the middle of one of the oldest neighborhoods in South Walton county.
Remind them also of the TAXPAYER money which has been wasted defending their LAST rezoning of this property in court, where the county LOST. Tell them to stop wasting your money.
Ask them what has changed that makes this rezoning more legal than the last.
And, "scrivener's error", my sweet Aunt Fanny. The original zoning of this parcel was not an error - the buyer made an error when he listened to whoever told him that this was zoned commercial. Let him go to court to get it changed, instead of the citizens having to go to court to keep it as it is legally zoned.
And ask them how stupid they think we are - do they think we've forgotten that this rezoning was already declared illegal in the last year?
It's the definition of insanity - repeating the same action and expecting a different result.

May I ask what you are talking about?

Is it the bank who is asking for the land-use change?
Beach Fanatic
Yes, this rezoning was already declared illegal back in Feb. In Feb. a judge ruled against the development company of Nature Walk and our County stating our commissioners should not have approved the beach club because the land was only zoned for residential purposes. It was my understanding that this zoning COULD NOT be changed but we all know our County makes up the rules as it goes along! If they want the zoning changed, unfortunately they will have it changed.

That's another question to include in your email/call to the commissioners.
Why has this been proposed?

Could be wrong but looks like the Lender SPCP Group LLC did not foreclose the Villa property; the foreclosure sale was set aside. Meaning that Seagrove at the Beach LLC (NatureWalk/Olsen et al) still owns the dirt. I do not see where Seagrove at the Beach LLC has filed for BR. However a receiver has been appointed by the court: Seagrove Villas Motel Receiver LLC. I believe that the Lender is requesting the "correction" to the FLUM according to the document submitted by the attorney who requested the hearing.

Interesting how some folks are so up in arms about this, yet are not concerned about Alys Beach trying to change their zoning to allow for over 300 new residential units on their property, which will clearly overwhelm 30-A. Also interesting to note that the ring leaders or the opposition here are also members of the family that owns Alys Beach.

Hmm, I guess I will have to wander down to Alys Beach and ask my family for a nice house. You clearly have me confused with someone with a loooooot more money.
Start your own thread on Alys Beach, with information about the public hearing, and get people up in arms if you want to.

I sure hope some folks involved in the development along 30A understand that what they have to market is a stretch of coast that used to be developed wisely and with an eye to their future. Each time I come down I am saddened to see the huge developments. Overbuilding diminishes the value of everyone's investment. People in for the short term gain will take the money and run. Oh, and do their vacationing elsewhere. The coastal area is your comodity. If it becomes a walmart parking lot you can kiss its value good bye. Do local politicians not appreciate this? It needs to be "hard" to get in..not easy...

Very well said.

I know this may seem like nothing more than semantics, but just to clarify, Walton County doesn't have "zoning." Walton County has a "Land-Use Code" and any property owner can legally petition the County to change the land-use category for their property. So, don't be thinking that they cannot legally do it. I believe what the Court ruled earlier on this case is that the County acted incorrectly approving the project given the current status of the property.
If you are unfamiliar with the Land-use code for Walton County, go to Walton County's website, and download yourself some, or all, of the code. There are guidelines for changing land-use, which the County must follow when making changes. This project may easily pass if there isn't enough opposition present with factual information as to why the change should not occur. It ain't rocket science. Go get familiar with the Land use Code, and use some common sense to present your case to the County. If you cannot be present, state your case to each Commissioner via email. By the way, you don't have be a full time resident of Walton County, to have an opinion and a voice.

Either way, adding more residential units or expanding a development is quite different from once again trying to change the use of a property so you can build HUGE COMMERCIAL BUILDINGS.
Beach Lover
As you say "The enemy is ignorance". What "HUGE COMMERCIAL BUILDINGS" do you speak of? Who is planning "HUGE COMMERCIAL BUILDINGS" on this site? The Beach Club at Naturewalk? This property has nothing to do with Naturewalk at further

Well, if you think the parcel ought to be classified "commercial", please tell us why & what for.

Coondog, We would love to learn more about Alys Beach development, but please start a new thread for that. This thread is very specific and about Nature Walk attempting to change the land use for the Seagrove Villas.

Sorry, I guess I am totally insane to think that the people who wanted to build a huge commercial structure that overwhelms the neighborhood are still trying to do the same thing.
You know, the ones that still own the property, and who have tried repeatedly to get the land use changed for said horrid project.

I think this is the first time they tried to get the land-use change. I believe all of the hoopla from the past was about the approval of the project, putting the cart before the horse kind of thing.

Hotel = Commercial. It's been there for 50 years.

yes, but...
commercial = a lot more than a hotel
and that is what people are afraid of if the land use is changed

Everyone needs to know what the original FLUM document said for this actual parcel; it clearly states that IF this structure is town down, THEN this parcel reverts to the residential zoning which exists on either side. It is grandfathered in as a nonconforming use.
I doubt the Commissioners have read it, and now I can't get the maps to download from the county website.

This is not the first thread on this subject. Here's another I started when this issue of a scrivener's error was brought before the BCC.
http://www.sowal.com/bb/local-government/39088-seagrove-villas-commercial-again.html
SJ is correct this is an attempt to change the FLUM, because that is the only recourse left. The court has already ruled that the proposed hotel etc. cannot legally be built on the site as it is currently mapped on the FLUM. So this is an attempt to get around that.
If allowed, it will be just another example of how, with enough money, time and lawyers, you can eventually build what you want in SoWal regardless of what the code says.
