... that I can't even see straight.
I just talked to my mom, and she told me that my dad and my brother were both victims of unneccessary police brutality (as if there was NECCESSARY brutality) yesterday. My dad got the brunt of it, but my brother feels guilty, since his little prank is what started the whole thing.
They were at a concert yesterday, and Dad, Wes, and my cousin all had to use the restroom. As Wes was exiting the porta-potty, he decided it'd be funny to moon our cousin. Well, the power-hungry event security didn't take too kindly to that and told Wes he had to leave the premises. My dad tried to get back to my mom to tell her what happened, and when he was talking to her, he evidently leaned just a little too close to one of the policemen, who drove his knee into my father's back and took him to the ground. My mom told me that there were six cops on my dad, and they were hitting him and shoving him. They hit him so hard at one point that his head started bleeding, and he has numerous bruises and bumps. He also just had back surgery last month, and the force with which the guy kneed him could've seriously jeapordized his recovery.
What's even worse is that the cops tried to charge my dad with assault on an officer (even though my dad wisely didn't fight back. All he did was yell, "Stop! You don't have to do this!") and being drunk in public. (He'd had two beers, and I know my dad.... two beers isn't going to do much.) They took him to the police station and ended up letting him go, but they're demanding that my family pay $96 to get out of this whole mess. My parents say they'll pay it just to put the whole thing behind them, but they don't want to. They're pissed off, and my dad feels violated and humiliated. He's getting all his wounds checked out tomorrow and he has a consultant with an attorney next week to see if he has a viable case against the police department.
My question is this: should they fight it, or should they just bite the bullet and pay the money? I say they should fight it. Even if they get nothing from it, at least they can get the word out about how inhumanely they were treated.:pissed: :pissed: :pissed:

That sucks. I think your dad might do best to pay the $100, and then spend another couple of a hundred to go to a therapist to talk through his frustration and what has to be anger, which resulted from this traumatic event.
I can sense your frustration by reading your story. I'm missing bits and pieces how a security guard escorting the mooner off the premises turned into your dad getting kneed and taken down by the police when telling your mom the story.
I bet those security officers have to go through training to learn how to control a crowd by showing the crowd who the boss is. The concerts which end up with deaths or violence can all be traced back to the concert goers getting out of control. Maybe it starts with a mooning, then a guy getting unjustly tackled by security, then the drunk masses jumping the security guards, then all hell breaks loose and it becomes a free for all.

The attorney will be the best one to advise him if it is even worth going after. I suspect if your dad has some injuries as a result of the treatment by the police, it is important that he protect his rights going forward. I'd advise your dad to make a quick call to the lawyer before his actual consult date and get preliminary advice; I'd bet they'd tell him to stay away from trouble, and not to have any contact with the police department personnel or pay/sign anything until his consult.

😱 Sorry PV. Parents that produced someone as sweet as you should never be subjected to that type of abuse. :(

Though I've never met DaddyPotatoVixen, I'm still trying to picture someone who must be a gentle man, being mistaken for assaulting a police officer. I'm also curious as to whether the security was off duty cops. If they were working as independent security contractors rather than police, wouldn't they have more explaining to do, and wouldn't they possibly face assault and battery charges, as well as be responsible for medical damages?

I still don't know every little detail, but my mom told me everything she could before she got too upset over the whole ordeal. From my understanding, my dad didn't do anything to provoke the officer.

I just talked to my mom again. Here's what the over-zealous young cop took as an "assault" against him:
My mom and dad were trying to explain to the cop what happened with Wesley, and since the band was playing quite loudly, my dad had to lean close and raise his voice so the guy could hear him. Evidently, that counts as a threat against an officer.

It seems that if you have a case, you should go for it, and contest it. If he doesn't have a prior record it may be dismissed. If the deputies were out of line, brutality is not acceptable! If they get away with it, they'll do it again.

That's part of the problem. My dad and my brother both have prior records. They both have a handful of minor traffic altercations, Dad has two DUIs, and Wes has a drunk in public and an assault charge. (He's a bit of a misguided soul, but I love him to pieces, and he's really turned himself around.)
My mom thinks that my dad probably will have less of a chance to fight this since he has those DUI charges, but we're still at least hoping that the offending Officer gets some sort of punishment. At least then the $96 would be somewhat worth it.
