Property line issue

We have a neighbor who has lived next door to us for about two years now. Just himself and his wife. Probably in their 60's. Before they bought the house this man that was living in the house and remodeling it at the same time removed the property line stake that was in front of the telephone pole between our property and that property. It was the property stake the city put there upon surveying the property. When we moved in this house back in 1994 this elderly lady lived in that house and had lived in it probably 30 years or more. She took us up to the telephone pole and uncovered the property stake buried in the ground right in the middle, showing it to us. Then covered it back up. First, he was just coming over around two or three feet into our yard, we figured it was because of him having to use our yard to turn his mower around. This morning upon mowing his yard he came 6 or 7 feet over into our yard mowing that section of our yard all the way down to our fence line at the back yard as if it is his yard. He mowed our entire side yard right by our bedroom window including all the way up to the street, a good 7 foot wide area. My husband says he doesn't care if he mows it as long as he is not trying to claim that part of our yard. I feel he is. I just went up there and put a pressed board stick that I spray painted red on the top part down in the ground right in front of that telephone pole to mark the property line. Should we say anything or let it go? We don't want to have to pay for another survey and have another stake put there, however I feel that stake does need to be replaced. We have a copy of the survey of the property when we bought the house showing where it starts. Just wondering what other people think. Thanks. :idontno:

Thanks NoHall. Yeah, I just verified when he said 'he' he meant HIM, the neighbor not himself. Grayt question though, not only cuz of my grammar skillz but also cuz it has been known to happen with him and some peonies too. I should have had them mulched too. ;-) I will try it. It was like 3-4 ft tall. :( Appreciate it, gull.

Hard to be grammatically correct when you're grieving.

My dear Dad mows my yard for me, and I've learned the hard way to be very clear about my bedlines. He used to think that it's okay to deadhead flowers with the lawnmower, too.

I feel your pain! Good luck!

My daddy took great pleasure in running right over everything in the yard. Mom never had a good flower bed until this year. Daddy would run right through them God love him.

Tangent: Between your 'tar and your siggy line, I'm in perma-giggle.

Back to the thread: It's tough to fuss at Daddy when he's sweet enough to mow the grass for me...

(Oops; that was a tangent of a tangent. We weren't talking about plants, we were talking about property lines!)

One day you or your neighbor will eventually have to have the property surveyed for selling purposes, a fence, or for some other reason.
I would jokingly thank him for mowing part of your yard and ask him why he never finished. Tell him you'll buy him a six pack if he does the whole yard next time.

Depends to on which subdivision your in, T S Michener surveyed with chains years ago, and there are extra feet floating around. Mine has been surveyed at least 4 times, and all were different. I go by the old fence. I think I'd put the marker where it was originally, and build a fence!

Well. LadyD, hope your neighbor turns out to be as nice as my new neighbor. Hubba spoke to him and he was very nice and apologetic about my hydrangea, and said his brother backed over it on the mower trying to turn around. He said he would be happy to pay for a new one.:D I don't think I'll ever give him any receipt since he was so dern sweet about it!
