I think what's most important is that the judge is ordering trump to prove he declassified the documents. Of course, even if he has someway of proving that, which he doesn't, he is admitting he had the documents, and he is admitting he didn't return them when he was legally ordered to do so. And that is still possessing documents that belong to the United States government, and obstruction. They have documented proof of those two crimes, and as soon as his co-conspirators start caving, most likely, the espionage will be proven.
