NOTHING aggrivates me more than when a job drags out offering you a position for over 2 months - finally offers you a position after they keep saying they will call- but don't- you resign from your amazing job you've had for 3 years, break your lease and basically pay $5G  to do so, lose the best roommate you've ever had  - only to talk to your new company for over 1 1/2hrs going over your employment handbook/filling out w2's, to then proceed to hunt for homes like a madwoman, to then have the bosses hubby call you to tell you they've resigned their offer knowing full-and-well everything you've done to make yourself available to them.

I've lost my job/career.
I've lost my home.
All I will have is these cute dogs and no where to go...

Un-friggin-believable.:bang:

Isn't it a bit late for that? How unethical can you be?
Seriously- it's against the law to do this.
But frankly- I now feel I have dodged a bullet.
Too bad too- some employees were quite nice. I really enjoyed talking to them.

So- if anyone needs some freelance design OR a decent artist/art assisant for any reason- I am currently available ... unfortunately.

Help a girl out! I've never been this much of a mess in my life.

P.S. I had fun meeting SBartoldus and Potato Vixen last night ;-) Thx for saying 'Hi!'

I am sorry, but that makes no sense at all!!!! I am, you loose 2 employees, then basically hire another employee, then tell that employee you can't hire her because of the 2 employees that left you. WTF????????????

I agree. Sounds totally flaky.

Oh and in the letter it said "we didn't take this decision lightly"- um yeah right, they called less than an hour after I left the office where I was signing papers for them.

They just hired 2 other people along with me. Still- makes no sense.

FYI- I am a VERY loyal employee. I have been at my current company for 3 years and have worked well over the expected 40+ work week and I love it. My boss says I have been an "invaluable asset" and have handled myself in a more than professional manner by giving more than a 3 week notice. He is even throwing me a going away party this Tues. I don't think I have the heart to tell them what has happened to me. My secretary already gets weepy when we talk about me leaving...

I think you should notify your current employer in Atlanta (is that where it is?) and let them know what's going on. This is something that you had no control over. Who knows, they might make some arrangements for you to return in a new or different position. This is a case of why we don't burn any bridges.

The funny thing is- they have no idea that my dad owns a major company and knows the laws...

Beachmouse is right about Florida employment...there's probably a statement in the employee's booklet you've got. They can let someone go for no reason whatsoever at the drop of a hat (of course the employee can walk out as well). http://www.akers-boswell.com/yl/atwill.html

Why not get a job at your dad's company?

BlueFox,

Sorry to hear about this. Have you spoken with anyone over at Fresh Creative (formerly O'Connor Ricks)?

They hosted an event with us last week at the gallery and what a great company. Randy O'Connor is the owner and everyone associated with them couldn't have been more upstanding. Their portfolio of work was excellent, give them a shout.

But this has nothing to do with employment- I never worked a minute there- look up a thing called "promissory estoppel."

My father's company is in Atlanta- and has nothing to do with creative services. Besides- I'm very driven and determined to make it "on my own"...

Thank you for the lead- I will be in touch with them as soon as I head back to Atlanta and have a minute to breathe...

The term is called employment at will. This gives both the employer and employee the right to cease the relationship at any time with or without cause or recourse. This is the legal part and is designed to evade the "contract for employment" issue, but does not make what they did moral or ethical.

Look at it this way: The pain is real and it hurts. We all hurt for you and many can equate what happened to you to something similar that happened to them.

But they may have done you a real favor. Just think how this would play out 6 months, a year from now. What if they cut you loose then? Also, what would the day to day work enviroment be with folks like this? It would suck I imagine. These people sound like real idiots. You are better off without them!

Hang in there girl. You can do it!!!

Remember this, and you can argue the numbers a point or two, but 10% of the jobs are found through advertised openings (newspapers, internet) 10% from employment agencies, and 80% are from friends. You have got them here and all over. USE THEM!!!

In the meantime, go see D&K and wait tables. It'll put $ in your pockets and you might just meet a good employer there. They are crying for help.

Sowallers, get with it and find her a job!!!

The exception to the employment at will would be if you are in a protected class. I once received a job offer and they recended it when they found out I was pregnant. Illegal, yes. But there isn't much you can do.

I have been following your story - relocating, job, dogs, etc...

So envious, because I too want to be there so bad!!!!!

You are single, no kids and have a lot going for you!!! And quite beautiful I might add!!!

I - husband and 4 kids in tow, yes 4!!!

We are dreaming of the day for the sand and beach to be our home!!!

Stay there and work for D&K's, I would work there if I were there!!!!

Have fun and enjoy life - it's just simply toooooo short to be stuck in Atlanta traffic and pollution!!!!! I was at our neighborhood pool earlier reading Points North Magazine - the whole issue was about going green, ozone, smog, etc.... and I was thinking, I'm sitting here in Forsyth County breathing all this awful stuff I'm reading about!!! Just want to be on the coast, breathing in the salty air!!!!

OK - back to my margarita!!! Kids are back at the pool with Dad now!!!!

Sounds like it is one of those"not asked prayers" answered. There are many of those that have happened in my life. If your passion is to move to SoWal- DO IT! You can make it work. You might be surprised at where it leads you- I know I have been!

TTS, you are right. There are certain protected clases. All you can do is sue and file an EEOC complaint. It will cost 10X more than you can get and then you get a bad name in the employment community.
The whole thing sucks!!!:bang:

So he even says it wasn't my fault. Way to incriminate yourself...
Yes, it is a bummer, but I'm not so sure it is criminal. "Promissory estoppel" might be something to pursuit, only if you were going to sign a contract for employment for a particular length of time. As a few have stated, Florida is an at-will state (right to fire/quit), so unless you had a signed contract, which is rare, promising to pay a particular amount of money for a particular period of work, I don't think you have a case, BUT I'M NO LAWYER. I doubt that a Judge would believe that possessing a company handbook conveys a promise for contract, nor does quiting your job and moving to Florida.

Yes, it stinks, but life has many obstacles, which you must work through. Keep your head up and keep on looking. Maybe it's a sign that you weren't meant to be there. Maybe a better place still awaits you. Be strong.

Regarding protected class, are you in a protected class? (Everyone keeps mentioning pregnant people. Are pregnant people a protected class? I know about familial status, but in the US, a fetus doesn't seem to have any rights until it is breathing air outside of the mother's womb.)

Pregnant women are definitely a protected class! You are allowed to say "oh, S$*&" when your best women employee tells you that she is pregnant and will need 3 months at home with the baby but you can't discriminate against her! :D

Has the WCSO heard about that little labor law technicality yet?

wow- I just typed a really long reponse- and then hit the back button by accident and all was erased...

To some it up-

1. I am not a lawyer.
2. But- the lawyers say I have a solid case.
3. I don't sue due to lack of funds and general disinterest in dealing with people lacking of ethics and morals.
4. My father is not me.
5. Don't mess with the Irish. We tend to be fiesty when we've been wronged.
6. I am NOT pregnant, nor am I even dating anyone.

The end.

This 'will to work' law seems to strip employees of all thier rights. Let's say you're a nurse. You bust your :moon: daily. You show up when scheduled on time. You've never been in any trouble and have done lots of good things as a nurse, even saving a few lives a long the way. What if you're a devoted, accountable employee for almost 20 years, let's say, and you get a bully for a 'new' boss'? She can terminate your :moon: for no good reason at all. Just cuz she doesn't like you. Oops, there goes your sheeeet you always worked so hard for and cared so much about. Tennessee is a 'will to work' state too. What a crock o' crap. There is absolutely nothin' you can do legally. Vanderbilt in Nash Vegas did this to a really grayt nurse I know really well. ;-) If they can do it anybody can they have a huge law dept. I guess 2 young nurses could easily replace one more seasoned, almost topped out, nurse. :idontno:
Sorry BlueFox, try to count your blessings, it sucks but just be glad you're not with a backstabber all day everyday. They probably did you a big favor in a strange kinda way. Bullies suck and there should be a labor law against them. Good luck. Maybe free lance jobs would be the way to go. :idontno: Freedom is a wonderful thang.

Well, I know everyone keeps saying the "at will" work law- but this actually has nothing to do with employment- as I never worked for them. If I had worked there for even a day I wouldn't be able to do anything.

No offense- but I trust the lawyers here.

And you are all right- I am very glad not to be working under someone who would treat any employee this way. Horrible work ethic.

Luckily due to me having many other connections- I will be freelancing fulltime starting in the beginning of Sept. if anyone needs help with anything from birthday cakes (cake decorating is my hobby ;-) ), fliers for garage sales to one-of-a-kind wedding invitations, kid's handprint stepping stones to hand painted house plaques- I seriously do anything and all things creative.

Check out some past graphic work I have done...

Okay, I cannot keep my big mouth shut any longer. BlueFox (and now we know your real name), are you not concerned with airing all this on a message board? I am worried there might be consequences you did not anticipate for yourself. I am sorry for your situation, but want you to think before you type.
