What can you do if an employer doesn't pay you for your time? Noy only is it short a day but it was calculated incorrectly and they refuse to reimburse the difference. Is there any recourse?

I don't know the legal stuff, but I don't work for people who don't pay me for that work and I imagine stiffing you a day or more is not acceptable under law.

And I sure as hell don't work for people who cheat me. They screw with your paycheck, your benefits, unemployment, taxes etc. are sure to be screwed up and you will end up paying.

Errors found on paychecks are to be immediately brought to the employer's attention and should be resolved by the end of the next pay period at the latest or if it is a large amount, a mutually agreed upon payment plan to resolve it should be implemented.

Do you have documentation that backs up what you are saying - you will need that for any further action. Depending on the situation/amount, a letter from a lawyer might let them know you are serious and resolve it.

Call the Department of labor in your state. Be prepared to give a good clear description of what has happened.

Thanks Scooterbug. Ties have been severed. Never ever stick with anyone who doesn't pay! Still waiting to see if the final paycheck will be right (if it is written at all). I really hate the idea of spending more time and money trying to get justice on this one. Why is that the incompetence of others results in extra time, effort, and money expended on my part! :angry:

How do you document it? It is our word against theirs. So easy for them to say, no that person didn't work. I'm finding more and more that the things we have in place to dispense justice are not all that beneficial to those of us who actually tell the truth when testifying. I've been involved in a custody issue, an unemployment issue and now this where the other side flat out lied. In the custody case, she lied and the judge said she lied and yet nothing was done. I thought there was a perjury law. Anyway... When the party you are "battling" will blatantly lie to the judge or mediator, there is really nothing you can do, is there. It comes down to your word against theirs and you can only hope that their karma will kick their ass in the long run.

We'll fight it and see what happens, contact the labor board more on principle than on any hopes of recouping losses. Back to the smokin, drinkin, and cussin thread for me!!!!

Just so ya know, the last paycheck was also wrong, not to mention crumpled up after spending the day who knows where. That is incredibly unprofessional and actually very childish. We will mark this one up to a life experience, try not to be bitter and have confidence that karma has an interesting way in catching up with bad people. It is just very upsetting in this time of crisis in our area, when we are all supposed to be pulling together for the greater good of the community, there are some people who will cheat. It is the spirit of that greater community good that keeps me from giving more details about the establishment.

By the way, this was not my employer! I am very happily and thankfully employed by a wonderful company which treats its employees with the utmost respect and is managed by honorable people.
