Does anyone know if there is a way to find out if a property is in foreclosure before you rent?

There could/would/should be a Notice of Default filed, but FL foreclosures are so far behind with moratoriums on top of their delays. I think it's taking longer than a year to complete the process in most cases

Check the Walton County clerk of court website, it is free and searchable. Or, you could simply add to your lease the following clause "Should the property listed above go into the process of foreclosure, lessor shall return all deposits to lessee within seven business days and lessee shall enjoy exclusive and indefinite use and enjoyment of property without further obligation of rent paid to lessor".

That would be funny.

Yeah, well, it probably will not work. Here is the link to the public records search. Walton County COUNTY RECORDS VERIFIED THROUGH Friday, Jul 02, 2010. LAST CFN = 1123989 (v3.0.3)

Type in the name of your potential landlord and search for any legal activity. You might want to put some sort of 'out clause' in your rental agreement though, as I executed a lease June 1, 2007 and the landlord saw fit to never make a mortgage payment after May, 2007. I got my deposits back and went month to month after that. He tried to claim some BS about me leaving without enough notice and my advice on the counsel of Mr Kitty, lawyer to the stars, was "let him sue you". That was good advice, I have yet to be sued and that was two years ago.:lol:

Thanks for the website! Shows the current home we are renting is in foreclosure (which the landlord is denying) and the home we are looking at this afternoon seems to be in the clear. Thanks again!

Rental nightmare with Foreclosures

Does anyone know, if the judge signs a "Final Motion Summary", on the owners of a property that they are renting out long term, where who would the rent check be paid to?

More than likely rent would be paid to the bank (or entity) that took ownership in the foreclosure suit. However, good luck successfully making contact with anyone.
