In Florida the landlord or their agent may take care of this without a lawyer, that's just added expense that a judge could toss out.

The first step is a posted notification of demand for rent. This is best done with a witness. After that you begin the actual eviction process with the courts. It really helps if you have a lease, but if you don't and the tenant is on a month to month basis then you are basically registering a termination with the court. Once granted by a judge then the Sheriff's department gets involved.

Unfortunately at best you'll get a lien against the tenant and the cost of damages has to be recouped in a secondary lawsuit generally in small claims.

Call the clerk of court and they can walk you through the process and give you the correct paperwork. (they do not give legal advice) After formal notice, your tenant will either dispute the eviction and have to deposit the amount of disputed rent into the clerk of courts depository. This will be held til the outcome of the case. Or, the tenant will just leave, or the best outcome will be they pay up and stay on. That is, if rent is the problem. The Landlord Tenant Act of Florida tends to lean towards the tenant, IMOP, so have your ducks in a row. Be sure you gave proper notice to evict, if not...you are cooked. Good luck!!
