As we approach the holiday weekend, Walton County understands that many groups use these opportunities to fundraise for their organization, church or team. We would like to remind these groups that Walton County has a strict policy in regards to roadside fundraising in Walton County.

Roadside fundraising is the process of soliciting and gathering voluntary contributions by requesting donations from an occupant(s) in a motor vehicles, bikers, or pedestrians along the county roadway, multi-path or other sidewalk system.

On January 14, 2014, the Walton County Board of County Commissioners amended their Code of Ordinances Chapter 4, Amusements and Entertainment, Article III - Roadside Fundraising. The final amendments to the Ordinance were passed on May 20[SUP]th[/SUP], 2014.

The Ordinance does allow for roadside fundraising with the appropriate permits. The Ordinance is also very specific and limits what types of fundraising can be conducted, who conducts them, locations and the times during the year that permits can be issued.

1. No permit for roadside fundraising will be granted to be held on holidays, any day prior to or immediately following a holiday or anytime between March 1 and September 15 of any year.

2. Roadside fundraising permits will not be granted to be conducted on at the following locations:
a. County Road 30A and any intersection on County Road 30-A
b. Scenic Gulf Drive (formerly known as Old U.S. Highway 98) and any intersection on Scenic Gulf Drive
c. U.S. Highway 98 and any intersection on U.S. Highway 98

It shall be unlawful for any person to engage in, participate in, form or start any roadside fundraising on any county road in Walton County without first obtaining a duly authorized roadside fundraising permit from Walton County Administration.

Following are some of the conditions that must be met in order to be approved to receive a permit to conduct a roadside fundraising event.

1. An applicant must document that the roadside fundraising event has a charitable benefit for the citizens of Walton County. Upon completion of the fundraising event, a letter must be submitted to Walton County signifying receipt of the funds collected. If no letter is received, the organization will no longer be allowed to apply for a roadside fundraising permit.

2. The roadside fundraising event organizer is responsible for coordinating with all local government agencies that may be impacted by the activity. This includes but is not limited to, Walton County Sheriff’s Office, Walton County Code Enforcement, and South Walton Fire Department.

3. A written public liability with limits of not less than $300,000.00 for damage or injury to any one person for bodily injury or otherwise, plus $25,000.00 for damages to property, and for not less than $500,000.00 for damages incurred or claimed by more than one person for bodily injury or otherwise, plus $50,000.00 for damage to property.

4. The roadside fundraising permit holder must remain on site at all times during the event with the permit readily available upon request.

Violations of any provision of this article are punishable pursuant to F.S. § 125.69. Violations of County Ordinances shall be prosecuted in the same manner as misdemeanors are prosecuted. Such violations shall be prosecuted in the name of the state in a court having jurisdiction of misdemeanors by the prosecuting attorney thereof and upon conviction shall be punished by a fine not to exceed $500.00 or by imprisonment or by both such fine and imprisonment

Walton County understands the importance that fundraising provides to our local charitable organizations, organization, churches or teams, however these regulations have been designed to promote the public health, safety, and general welfare of our citizens.
