Can you pardon someone when they are still in the process-

e.g. make an indictment go away

Or can a POTUS only pardon someone after they have been convicted (or something else)?

Only after a conviction.

I have been hearing "others" say that it is likely that some pardons will be issued regarding people who have yet to be charged. Kind of like a pre-emptive pardoning so that prosecutors don't wait until the new POTUS to ring up charges, thereby eliminating the possibility of paroles from a future POTUS. So, are they misstaken that this can't happen? I don't know and can't find any sources to this being true.

From your post, it seems like that would be the best way for a prosecutor to act- wait until a pardon was unlikely to occur under a new POTUS before pursuing an indictment.

They cannot. If so, all of you should dump your mutual funds as you may end up in prison. Every large cap growth mutual fund had Wcom back in the late 90s. Bernie Ebbers was convicted of fraud, so I suppose all of the investors should be in prison as well.

The D.A. in this case is a bit of a nut job, but the people on this board would like to see anyone who does not ascribe to their politics jailed, regardless of merit. I see that anyone who dares question the new Messiah is branded as racist, told to "get over it, the election is over". However, this unhealthy obsession over the Bush administraion and hate spewing is acceptabe here.

From what I can gather, Cheney is not being indicted for being a stockholder, but for 'engaging in organized criminal activity'. Him holding stock in a private company contracting w/ the federal government is being presented as a conflict of interest.

Gonzales is being charged with using his position to stop investigations into wrongdoing by the company.

It's all in the beginning stages, so it will remain to see if he actually did anything of note or if the prosecutor is just a sour grapes wack-a-doo.
