South Walton Community Council Needs Your Help! Cypress Lake is going to trial.

Overview

The Circuit Court case against the Cypress Lake development goes to trial next week. As you know, this is a very expensive undertaking and we are at the point where the bills are getting serious. Our objective is to have 100 people donate $100 each. Please consider this to be an investment in our community.

South Walton Community Council (SWCC) and Beach-to-Bay have teamed up to contest this development. We are not anti-development; we simply want to see responsible development. And we want the county to follow their own rules and ensure compliance with the Comprehensive Plan and Land Development Code.

Cypress Lake fails to meet the Comprehensive Plan requirements listed below:
  • 25 foot setback with Topsail Hill Preserve State Park
  • 20 foot setback with Cypress Dunes Phase 2
  • 20 foot 30A Scenic Corridor landscape buffer
  • Compatibility with the neighborhood; Cypress Lake has double the density of adjacent developments

HELP FUND CYPRESS LAKE LAWSUIT.

Cypress Lake Lawsuit filed by Beach to Bay Connection, Inc., South Walton Community Council, and local residents to protect Topsail Hill Preserve State Park and the neighborhoods on the west end of 30A from a development that is out of compliance with the Walton County Comprehensive Plan. This action started in December of 2017.

The case went to trial in early November. We have received an interim ruling from Judge Green that states that the Cypress Lake density was calculated incorrectly. The case is continued until Walton County presents the correct calculations for density for the parcel. We will need our own expert witness to check the information that the County submits. Attorney and expert fees continue.

Please financially support our endeavor to protect Topsail Preserve and the west end of 30A. Walton County must follow their own rules.

South Walton Community Council March 2019 Update-Cypress Lake

SWCC is a 501(c)(3) non-profit organization that seeks to secure reasonable implementation of laws relating to land-use planning, environmental preservation and growth management in South Walton.


Cypress Lake Update
South Walton Community Council has filed a Notice of Appeal to the First District Court of Appeal to challenge the Cypress Lake judgement issued by Judge David Green on 02/18/2019.


Walton County Circuit Court Judge Green ruled that plaintiffs could only bring complaints that dealt with intensity, density and use. The ruling was based on a controversial precedent case (Heine v. Lee County) that has statewide implications, as it limits the rights of citizens to challenge development that fails to comply with Comprehensive Plan requirements.


The Cypress Lake ruling failed to consider significant deficiencies related to buffers and setbacks, including the Topsail Hill Reserve Sate Park buffer and the 30 A Scenic Corridor landscape buffer. We believe these are important Comprehensive Plan requirements that need to be incorporated into Cypress Lake as well as future developments.


Cypress Lake is a proposed development located on the west end of 30A, across from Emerald Walk (Flamingo Village). It borders Topsail Preserve on two sides. Walton County issued a Development Order in December 2017 for a project comprising 141 residential units and two four-story commercial buildings on 22 acres of land.


SWCC is represented assisted in this effort by attorney Terrell Arline, as well as 1000 Friends of Florida, a Tallahassee-based nonprofit that seeks to uphold key growth management principles and maintain the rights of citizens to participate in their community’s planning process.


This is a landmark case for the State of Florida and citizens’ rights to redress local governments on land use issues.
