As many of you know I had my car rear-ended and totaled on HWY 98 back in Septmeber. The youngster who was piloting the Chevy Tahoe at a speed sufficient to destroy my Honda Element was text messaging and thus distracted (by his own admission). He hit me with such force he knocked me into a fairly new Volvo and damaged it as well. As it turned out, the lad's liability limit didn't provide enough coverage to pay for my essentially new car and the Volvo's repairs, thus, it was on me to file through my own insurance company (Geico) to replace my car. Progressive was gracious enough to provide a rental car to me for one week and spot my deductible. Rental went as planned, no problems. Fast forward to yesterday-I get a letter in the mail from Hertz stating that Progressive is now refusing to foot the bill for the rental and my credit card was charged (I hadn't gotten my new statement yet so didn't know). We are not talking a mint of money here, it is only about $75, but it is so sleazy. I am going to write a letter to the insurance commissioner as well as Progressive. I should have called Ed Walborsky!

That is sleazy. This is the car wreck what won't die- no wonder car insurance is so expensive- they have to pay all these people to drag it out, mess with it, look at it 27 times, put it away, get it out, talk to you, talk to them, yada yada.....

But if all goes right for Progressive they will have an extra $75 in the bank:roll:

I would still call Ed! As I am sure you know, sometimes a simple letter from your lawyer to the Insurance Company can work miracles.....

You should be able to take the other driver to small claims court, huh?

Isn't there a minimum of $100k for insurance in Florida? Also, I thought that if you didn't have enough insurance, they could go after your assets to cover the costs. (I know there is a scare commercial from Allstate in regular rotation on that one.)

Definitely contact a lawyer - you didn't do anything wrong and are getting screwed.
