so who's really on the hook for that draw(s)? looks to me like the bank officer. he allowed a draw on a loan without written consent from the loan holder.

Not uncommon. I stopped a local bank (okay, I'll name them - COLONIAL) from doing the same thing on our construction loan.

The loan clerk was buddies with our builder, and she just thought that was the easiest way to handle it.

That should have been my first clue that everything that ever happened with that loan was going to be screwed up - and it was.
